Terms of Service

Effective date: September 8, 2026

1. Agreement and eligibility

These Terms of Service govern access to Classroom Check-in, including classroomcheckin.com and related attendance and communication features (the “Service”), provided by Tea Labs LLC (“Tea Labs,” “we,” “us,” or “our”).

By accepting these Terms when registering or otherwise entering an agreement that incorporates them, you agree to these Terms. If you accept for a center, school, company, or other organization, you represent that you have authority to bind that organization, and “you” means that organization. If you lack that authority or do not agree, do not use the Service.

Accounts are for adults who are at least 18 and authorized to act for the customer. The Service is designed for staff to manage attendance and related communications. Children may not create accounts or independently operate the Service.

2. Accounts and permitted use

During your authorized use, we grant you a limited, nonexclusive right to access the Service for your organization's internal activities, subject to these Terms and your plan. You are responsible for your authorized users, protecting credentials, assigning appropriate access, and keeping account information accurate. Notify support@tealabs.dev promptly if you suspect unauthorized access.

You may not use the Service unlawfully, send unsolicited communications, access another customer's records without permission, interfere with security or operation, introduce malicious code, or attempt to extract source code except where applicable law permits it. You may not resell access without our written permission.

3. Student information and customer responsibilities

You retain your rights in information you submit to the Service (“Customer Data”). You authorize us and our service providers to process Customer Data as necessary to provide, secure, maintain, and support the Service, follow your authorized instructions, and comply with law. This authorization does not transfer ownership of Customer Data to us or authorize its use for unrelated advertising.

You are responsible for having authority to provide Customer Data, supplying required notices, obtaining required permissions and communication consents, maintaining accurate records, and complying with laws applicable to your organization. These responsibilities do not remove obligations that applicable law places on Tea Labs.

Provide only information reasonably needed for attendance and related communications. Do not submit payment card details in student records, government identification numbers, medical records, biometric identifiers, or similarly sensitive information unless we separately agree in writing to support it.

We handle personal information as described in our Privacy Policy. A separately signed data processing agreement controls over conflicting provisions concerning its subject matter.

4. Attendance, supervision, and notifications

The Service is an administrative tool. You remain responsible for supervising students, verifying attendance and authorized pickups, maintaining appropriate safety procedures, and arranging backup procedures during outages. An attendance entry or notification alone does not verify a person's identity or authority to collect a student.

Email and SMS delivery depends on networks, recipient settings, service providers, and other factors. Messages and records may be delayed, interrupted, or inaccurate. Do not rely on the Service as an emergency alert system or the sole means of confirming a student's safety. We do not guarantee that using the Service satisfies any particular licensing, insurance, school, or franchise requirement.

5. Email and SMS

Where enabled, the Service sends attendance and related operational messages on behalf of participating organizations. You must obtain and retain any required recipient consent before requesting messages, keep recipient information accurate, and honor withdrawal of consent.

Recipients who separately opt in to SMS may receive recurring attendance and related service messages. Frequency varies with activity and settings. Message and data rates may apply. Reply STOP to stop SMS messages, or HELP for assistance, or contact support@tealabs.dev. Carriers are not liable for delayed or undelivered messages. A recipient may need to arrange an alternative way to receive attendance updates after opting out. Acceptance of these Terms does not itself enroll anyone in SMS.

6. Fees, renewal, and cancellation

Applicable fees, billing intervals, usage charges, renewal arrangements, and any trial terms are disclosed when you purchase or in your order. You authorize our payment processor to charge the payment method you provide for those agreed amounts and applicable taxes.

If your order specifies automatic renewal, it renews as disclosed until canceled using the method stated at purchase or by contacting support@tealabs.dev. Cancellation, remaining access, and refunds are governed by your disclosed purchase terms and applicable law. We will notify you of changes to recurring fees before they apply, allowing any notice and cancellation rights required by law or your order. We may suspend paid features for overdue amounts after reasonable notice.

7. Service changes and outside providers

We may update the Service and add, replace, or discontinue outside providers. We remain responsible for our obligations under these Terms. Changes do not expand our rights to use Customer Data beyond these Terms, our Privacy Policy, or a separate agreement. We will provide notice of material reductions to paid functionality where reasonably practicable and honor applicable contractual and statutory remedies.

8. Intellectual property

Tea Labs and its licensors retain rights in the Service, software, branding, and documentation. Except for the access rights expressly granted here, no intellectual property rights are transferred. If you voluntarily provide feedback, you permit us to use it to improve the Service without compensation or attribution, excluding confidential Customer Data.

9. Suspension and termination

You may stop using the Service and request account closure at any time, subject to your payment obligations and purchase terms. We may suspend or terminate access for material breach, a security threat, unlawful activity, or a legal requirement. Where feasible, we will provide notice and a reasonable opportunity to resolve the issue before acting.

We may discontinue the Service with reasonable advance notice. If we end a prepaid subscription for our convenience, we will refund unused prepaid fees for the discontinued period. Following closure, we handle Customer Data under our Privacy Policy and any separate agreement. Request an available export before closing your account; contact support if you need assistance.

10. Disclaimers

To the extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, and noninfringement. We do not warrant uninterrupted or error free operation or that the Service will meet every requirement. Nothing here excludes a warranty or right that cannot lawfully be excluded.

11. Limitations of liability

To the extent permitted by law, neither party is liable under these Terms for indirect, incidental, special, consequential, or punitive damages, or lost profits or revenue.

Each party's aggregate liability arising from these Terms will not exceed the greater of USD 100 or the amounts you paid or owe for the Service during the 12 months before the event giving rise to the claim. These exclusions and limits do not apply to fraud, willful misconduct, your payment obligations, or liability that cannot lawfully be excluded or limited. This section applies regardless of the legal theory of the claim.

12. Governing law and disputes

These Terms are governed by the laws of [INSERT STATE], excluding conflict of law rules. Subject to mandatory legal rights, disputes will be brought in the state or federal courts located in [INSERT COUNTY AND STATE], and the parties consent to their jurisdiction. Before filing a claim, please contact support@tealabs.dev so we can try to resolve the issue informally. This does not prevent urgent relief or extend a filing deadline.

13. Changes and general terms

We may revise these Terms. We will post the revised version and effective date and provide reasonable advance notice of material changes by email or within the Service, unless a shorter period is necessary for legal or security reasons. Changes apply prospectively. Where acceptance is required, we will request it. If you do not accept an applicable revision, stop using the Service before it takes effect and contact us about closing your account.

These Terms and any applicable order or signed agreement form the agreement concerning the Service. A signed agreement controls in the event of a conflict. If a provision is unenforceable, the remaining provisions remain effective. Failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination will survive.
